Arbitrators

Appointment, challenge and replacement of arbitrators should comply with the arbitration agreement. Any person having full legal capacity may become arbitrator.

If the arbitration agreement previews that the dispute submitted to the arbitration should be resolved in compliance with the rules of procedure of the present Arbitration Code by one or several arbitrators, appointed in accordance with the Arbitration Code for Transport, the arbitrator or superarbitrator should be chosen among the persons presented in the optional list of arbitrators of the Arbitration Court for Transport.

The Arbitration Court for Transport appoints arbitrators, presented in the optional list of arbitrators, being reputable legal and technical experts, professionals in the economics, experienced in the area of transport and related activities, as well as in other areas.

When appointing an arbitrator, his professional specialization, linguistical experience as well as the complexity of the case submitted to the arbitration should be taken into consideration.

The parties should agree on one or several arbitrators to resolve their dispute, the number of arbitrators being always odd.

If the parties did not agree on the number of arbitrators, the dispute should be resolved by sole arbitrator, presented in the optional list of arbitrators, published by the Arbitration Court for Transport.

In case of several claimers or respondents the parties having common interests should appoint only one arbitrator.

    Juliette M. Passer is a U.S. attorney, has over 25 years of broad international transactional experience, specializing in corporate and project finance, as well as international joint venture transactions, arbitration and e-commerce.
    Ms Passer holds a JD (cum laude) from Cardozo School of Law and studied Soviet Law at the Columbia University School of Law.

    She practiced law with the international law firms of Debevoise & Plimpton and Patterson, Belknap, Webb & Tyler in New York specializing in corporate and project finance.
    She has represented both US and foreign clients in transactions in such sectors as aviation, aircraft leasing, transportation, pharmaceuticals, petrochemicals, telecommunications, technology transfer, information technology (IT) and the Internet, executive compensation and wealth preservation, advertising, clothing manufacturing, defense conversion, energy production and conversion, entertainment, non-profit organizations and printing, as well as in various arbitration proceedings.

    She has worked on international transactions ranging from mid-size joint ventures (such as a venture between a US-based IT company with a Turkish software developer with a Russian outsourcing team or a Russian tractor manufacturer and a US investment fund) and debt and equity investments into Central and Eastern European manufacturers by U.S. investment funds to $300 million debt restructuring of a U.S. telecommunications company and a $250 million petrochemical plant financing by a Finnish company, among numerous others, in such diverse markets as the former republics of the USSR, Eastern and Western Europe, China, Turkey and Panama, where Ms Passer has had an office since 2007.

    During the last ten years she also has been working with the Internet-based companies on a broad range of projects, from financings to licensing and domain names disputes, as well as international business transactions, international arbitration and general corporate representation for new media and IT companies.
    She also serves on boards of several companies.
    She is listed in Who`s Who in American Law and Who`s Who in American Women. As a pro bono undertaking she represents Russian artists, dancers and musicians.
    She is a frequent guest lecturer and adjunct faculty at the Russian Juridical Academy, Kaplan University, Marywood University, Moravian College and others.

    She is fluent in Russian and has a working knowledge of Ukrainian. She writes and speaks widely on the issues of law,arbitration and commerce in the emerging markets as well as the Internet, IT and ecommerce.
    She is a member of the Council on Foreign Relations and served on the Boards of Directors of the Council for Trade and Economic Cooperation and other companies. She maintains a wide range of contacts in Russian regions as well as in Central Asia, Eastern Europe, China and Panama.

    From 1990-1993 she was an U.S. Adviser to the Committee of Economic Development of St. Petersburg for the development of free economic zones and participated as an U.S. expert in drafting and commenting on various legislation for several Republics of the former USSR.
    From 1997 until January 1999 she was an US adviser to the Finance Committee of St. Petersburg.

    Bea Verschraegen is Full Prof. of law at the University of Vienna, Director of the Section of Comparative Law, Unified Law and Private International Law, Director the LL.M.-Program on "European and Asian Legal Studies - Shaping and Steering of Cross Border Transactions" (EALS), Co-ordinator of the Special Program on Private International Law, Member of the Senate`s Appeal`s Commission of ViennaU.

    She is Adjunct Prof. at the University of Macau, and has been Prof. at Pan European University (Bratislava, Slovakia) from 2004-2014 and its Vice-Rector for International Relations from 2009-2014.

    She founded the Interdisciplinary Association of Private International and Comparative Law (IACPIL) in 2009 and has been serving as the president of IACPIL since then. Verschraegen has been invited as Guest Prof. by many universities world-wide. She has been serving on numerous evaluation commissions world-wide, on law reform institutions i.a. as expert in the field of Private International Law, Comparative Law, European Law, Mediation and ADR.

    After her term as President of the "Commission Internationale de l`Etat Civil" (Strasbourg, 2000-2001), she was nominated "Présidente honoraire" in 2002.

    She was awarded the 2014 Prize for Special Services to Russian Higher Education.

    Her publications cover Private International Law, Comparative Law, European Law; Mediation and ADR and Civil Law.
